Traffic Tickets

The Lam Law Corporation, APC offers to fight your traffic tickets for you via Trial by Written Declaration pursuant to California Vehicle Code §40902.  Typically when you receive a traffic ticket, you will receive a citation suggesting that you either pay the citation or appear in court to request a hearing date. What is typically unknown to the public is that you can fight your ticket entirely by mail without making any court appearance.  You can make a written not guilty plea by mail pursuant to California Vehicle Code §40519(b) and request a trial by written declaration pursuant to California Vehicle Code §40902.  Furthermore, if you lose your trial by written declaration, you can request a Trial De Novo (new trial) pursuant to California Vehicle Code §40902(d).  You will then receive a new trial date at which to appear and contest your traffic ticket for a second time.  By contesting your ticket by trial by written declaration, you get TWO opportunities to win. 

Furthermore, a trial by written declaration requires the citing officer to also write a declaration providing evidence that you violated the California Vehicle Code you were cited for. This procedural hurdle results in dismissals rates of 80% for Lam Law Corporation, APC clients and even if you lose, you can still request a Trial De Novo and contest the citation for a second time. At the Lam Law Corporation, APC, you will get an actual attorney to review your trial by written declaration to make sure that it is written in the best possible manner to receive a dismissal.

The Lam Law Corporation, APC's confidence in getting your ticket dismissed is evident by our payment structure. The costs for this assistance is ½ the amount of the citation should you win and have the citation dismissed. If you lose and are found to have committed the traffic infraction, there is no charge for our services. For instance, if you receive a $500 speeding ticket, we will assist you in fighting this citation. If you win, the costs to you is $250. Should you lose, our office will not charge you anything.
